I just had surgery on the 10th of June for my thumb extensor tendon. But there is a problem, the Dr. accidently went in and performed the tendon repair on my flexor tendon that had nothing wrong with it... I've talked to him and he openly admits to have done the wrong surgery, and I was just wondering if theres anyone out there that knows what legal rights I have. Thanks in advance for any help, Honest Abe |

Make sure you watch OPERA tHURSDAY. Shes got a special on all the wrong surgerys that have happened. Even talked about some guy that left with no penis. Cant remember what he went in for. Saw the commercial for it Wed. Afternoon flipping channels. You definitly have a lawsuit on your hands if your that type of person. I would say that as long as it dont cost you any more money or anything extra and no pain and suffering to any certain extent then why bother. You will be like all the millions of other fucks who like to sue for stupid ass reasons.

I am currently working with a malpractice attorney concerning my wife's medical care. She went into full cadiac arrest in the hospital and had to be revived and then spent 2 weeks in intensive care. All as the result of a Dr's bad judgement. You would be amazed how hard it is to sue a doctor for malpractice. Damages are limited by law here in Texas. You may have a lot harder time than you think getting a lot of money. You will clearly recoup the hospital bill and any additional medical expenses recieved. You will be suprised to learn that if your insurance company paid for the surgery, you will only recover your actual out of pocket costs and the insurance company will get the rest (little thing called subrogation) You will have to prove actual damages to recover for anything else. Oh yeah the lawyer will get 40% of that. In my state that amount is capped at a maximun of 250,000 for pain and suffering and then you have to prove actual economic damages to revover there. The whole process can take up to 2-3 years since the Dr.'s insurance company will drag things out. In my state almost every malpractice suit is challenged and fought by the insurance companies. Thanks guys, I talked to an attorny and he wants me to wait at least another month before he does anything because I'm having some serious pain and complications in my hand right below the incision. BTW, the Doc agreed to a free corrective surgery, but I was still billed for the first and he promised I would'nt be billed at all.

Ok, I've only seen one decent response. Have him reoperate and take care of both bills himself. So he fucked up, so what? Maybe your boss should fine you for lost revenue the next time you fuck up at work. If you didn't earn it, it ain't yours and you in no way, shape or form earned a bunch of money by having the wrong op. performed. |

even if he cuts off your dick? I think as long as prognosis is full recovery than very small monetary compensation is in order. 10k or so. now if it was amputate the wrong arm or something than no price is worth it. this deal was minor though Quote:

I'm with thick, he did fuck up, and I don't want to sue the guy for all hes got. I've been out of work (and lifting) for about a month now and my hand hutrs like hell anytime I try to grasp something or anytime pressure is applied to where the incision was made. All I want is to be compensated for my loses and the pain I've been dealing with. Honestly |
